USCIS needs to examine the Green card procedure to balance effectiveness and
security
United States citizenship and immigration services are now forced up with
140,000 pending green card applications, due to new fee structure. To
deal with the backlog of applications, USCIS has decided to provide green cards
to all those staying in US legally, without any FBI background checks. The new
rule will able to perk up the status and lives of respectable immigrants, only
if the skipping of these FBI checks does not add any threat to national
security. At present immigrants applying for green card are
asked to undertake three major security and background checks, these are
consolidated federal law enforcement databases, fingerprint databases and name
checks or federal investigative files. Once the new rule takes on, all the
applications pending for 180 days and above will get a sanction on clearing the
checks other than name check, later if the name check of FBI investigative
process offers any unlawful information on the applicant the green card holder
could be arrested or deported. Whereas, United States citizenship and
immigration services are confident of the rule's ability to offer convenience
to the applicants, also USCIS argue that the rule would not interfere in
national security, as it implies only on green card applicants residing in US.
USCIS also counters the chances of precarious people receiving green card, as
according to anecdotal evidence name checks usually does not bring up any
dangerous information. But due to lack of statistics of illegal individuals
being caught up by name check, the authorities aren’t sure of any feasible risk
offered by the new rule. Immigrant advocacy group as already questioned the
importance of making every green card to undergo name check. When asked on the
new rule Bill Carter, FBI spokesperson, has been found stating "our position is
that we have no position". FBI needs to investigate how effective this name
check will be for preventing any threat to national security. USCIS and
officials must asses the importance of the name and the information offered by
it.
H-1B visa race begins again, but Green Card Lottery visa still a winner
Winning a US Visa Lottery is the dream of almost all the
people waiting to immigrate to America and become US citizens. While all the
American Visa categories are filled with application entries and interested
candidates lined up to get a US Visa, the most sought after Visa categories are
Green Card Lottery visa and H-1B visa. While Green Card Lottery visa is desired
and therefore applied for by almost every individual wanting to migrate to US,
H-1B visa mostly attracts employees willing to work in US. H-1B Visas allow
foreign skilled workers to work as well as reside in the US for as long as
their company sponsors them. This year, i.e. on 1st April 2008, the entries for
the H-1B Visa applications will open again. And in all this, the main question
remains whether or not the terrain for H-1B visa will increase any further,
especially as America is all geared up for the presidential elections this
year. Last year the United States Citizenship and Immigration Services (USCIS)
received 130,000 applications, almost double the number of applications allowed
for the allocation of visas in a day. This resulted in pressing the USCIS to
use automated random selection process to fill the 65,000 places selected by
Congress. Since majority of the H-1B visas are awarded to IT professionals,
major IT tycoons like Google and Microsoft have been pushing Congress to raise
the limit of the number of H1B visas. Most of the US based IT companies are of
the view that the increase in the number of skilled foreign man power in US
plays a major role in making it more competitive in today's global market.
Fortunately, their outlook did not go waste as it has caught the attention of
the two leading candidates standing for the upcoming presidential elections,
Barack Obama and Hillary Clinton. Both these Democratic candidates have gone
public with their views of being in favor of raising the cap for H-1B quota.
But till the time the Whitehouse does not consider lending a sympathetic ear to
the views of the top IT companies regarding the H-1B visa issue, all the IT
professionals willing to take the US journey will have to make do with just a
window of opportunity through a limited H1B visa quota. But with the Green
Card lottery visa, there are no such concerns as citizens of
almost all the countries in the world are eligible to apply for this US Green
Card lottery except a few countries such as: Russia, Canada, China,
Dominican Republic, El Salvador, Columbia, Haiti, India, Jamaica, Mexico,
Pakistan, Korea, Philippines, United Kingdom and Vietnam.

CA writes to US government urging green card system reformation.
Compete America urged US government to take steps on rectification of the
current green card lottery system. The group
"CA" who supports the implementation of flexible United States immigration
rules for skillful labor from foreign has written a letter to United States
Congress to take steps for reformation of the
USA green card lottery process. The letter states that the
group compromising of trade associates, cooperators and educators believes in
need of reformation of their H-1B visa along with the employment based green
card procedure. "Compete America" or "CA" insists that the need to
reform is important in sustaining America's competitive side. The letter also
states the apprehensions about educated foreigners being left subsequent
lottery procedure, due to declination of visa numbers. The group has showed its
concern on the procedure for employment based green card being outmoded
and out of date, as it does not support the enough amounts of green cards to
meet the requirement. CA exclaims, while the current cap for H-1B visa
applications is 65,000, United States Citizen and Immigration Service (USCIS)
got more than 133,000 such applications (all in a day) for year 2008. The
outdated system also forces foreign individuals to hang on for over five years
of time in order to get an 'employment based' green card. The concern shown by
CA over the US lacking in competitive edge is based on its failure in pulling
skilled foreigners unlike European Union, who using their blue card scheme are
taking benefit of stringent green card rules. In a letter written to the US
government, the CA also mentions how the European Union's blue card is going to
attract highly skilled and educated foreign individuals by providing them
temporary work visa. The blue card system may be under debate but has already
pulled innovative minds suffering in US green card system.
Any Green card holder could be extradited if found unlawful
According to a report, green card holders or owners go through lawful actions
in connection with filing of I-90 forms, when requesting for fresh green cards.
It has been indicated that many a times, permanent residents with warrant for
outstanding offences have been arrested, taken into custody or given Notices to
Appear through an I-90 enquiry. Earlier an I-90 procedure was clerical with not
much of detail background check of a kind to cause enforcement action. Usually,
when a green card holder or possessor loses his/her card or owns a green card
nearing expiry, he/she has to file an I-90 to acquire a new green card.
The green card acts as a testimony, that the particular person lawfully holds
the status of permanent resident of United States, thus even on the thievery of
a green card the individual is still considered a permanent resident or green
card holder. But, any person in spite of possessing a green card or permanent
resident status is subjected to be removed or exclusion from United States, if
found guilty to a crime. United States is using the I-90 process to pin out or
search individuals with any warrants for outstanding offences or crimes,
whether the offence is removable or not. Which is why, an individual is
subjected to resolve his/her any such crime or offence based matter, if
possible, before filing an I-90 application. The crime if registered, whether
removable offence or not, has the ability to show an impact on the individual's
capability of being a citizen of United States, as a good behavior or moral
character is must for naturalization. Thus, any offence during the five year
time span can be harmful to an individual's immigration benefits. If arrested,
the individual would be required to hire an attorney with enough knowledge on
immigration based offences or issues, as it'll help them in reviewing their
immigration position.
